This Right to be Forgotten Policy explains how you can ask Response Personnel to delete personal information we hold about you.

The right to be forgotten is also known as the right to erasure.

2. What is the right to be forgotten?

Under UK data protection law, you have the right to ask us to delete personal information we hold about you in certain circumstances.

This does not always mean that we must delete every piece of information immediately. Sometimes we may need to keep certain information where we have a legal, contractual, regulatory or legitimate business reason to do so.

3. When you can ask us to delete your information

You can ask us to delete your personal information where:

  • we no longer need it for the reason it was collected;
  • you have withdrawn your consent and we have no other lawful reason to keep using it;
  • you object to us using your information and there is no overriding reason for us to continue;
  • your personal information has been used unlawfully;
  • we are legally required to delete it;
  • the information was collected in relation to online services offered to a child.

4. When we may not be able to delete all information

We may not be able to delete all personal information if we need to keep it for one or more of the following reasons:

  • to comply with a legal obligation;
  • to keep tax, payroll, accounting or business records;
  • to manage recruitment, employment, temporary worker or contract records;
  • to establish, exercise or defend legal claims;
  • to prevent fraud or misuse of our services;
  • to respond to complaints, disputes or regulatory enquiries;
  • where the information is still needed for a contract or service you have requested;
  • where we have another lawful reason to keep it.

Where we cannot delete all information, we will explain why. Where appropriate, we may restrict how the information is used instead.

6. What to include in your request

To help us deal with your request, please include:

  • your full name;
  • your email address and telephone number;
  • any previous name or contact details you may have used with us;
  • whether you are a candidate, client, worker, referee, supplier or website user;
  • a clear description of the information you want us to delete;
  • any relevant dates, job applications, assignments or communications.

We may need to ask for proof of identity before processing your request. This is to protect your personal information and ensure we do not delete information following a fraudulent request.

7. What happens after we receive your request?

Once we receive your request, we will:

  1. confirm your identity where necessary;
  2. search our systems and records for relevant personal information;
  3. review whether the right to erasure applies;
  4. delete the information where we are required to do so;
  5. tell you what action we have taken;
  6. explain if there is information we cannot delete and why.

Where appropriate, we may also tell relevant third parties that you have asked for your information to be deleted, particularly where we have shared the information with them.

8. How long it takes

We will respond to your request without undue delay and usually within one month.

If your request is complex or you have made multiple requests, we may need longer. If this happens, we will let you know and explain the reason for the delay.

9. Will there be a charge?

We do not usually charge for dealing with a right to be forgotten request.

However, if a request is clearly unfounded, excessive or repetitive, we may be allowed to charge a reasonable fee or refuse to deal with the request. If this applies, we will explain why.

10. Recruitment records

As a recruitment business, we may need to retain certain candidate, client, temporary worker, payroll, contract or compliance records for a period of time.

For example, we may need to keep information relating to:

  • job applications and candidate submissions;
  • right to work checks;
  • contracts and assignments;
  • payroll and tax records;
  • client instructions;
  • interview, placement and recruitment records;
  • legal or compliance obligations.

If you ask us to delete your information, we will review what can be deleted and what must be retained.

11. Marketing removal

If you simply want to stop receiving marketing communications from us, you can ask us to remove you from our marketing list.

In some cases, we may keep a minimal suppression record to make sure we do not contact you again for marketing purposes.

12. Complaints

If you are unhappy with how we handle your request, please contact us first so we can try to resolve the issue.
